Although you need not prove adultery in Florida, the use of marital assets is considered a “waste of marital assets” in which the non-offending spouse can seek compensation. For example, if a Husband spends $20,000 on the extra-marital affair, their Wife will be entitled to reimbursement from the cheating spouse in the amount of $10,000.
