What Are The Signs That Your Spouse is Cheating from the Point of View of a Florida Divorce Attorney

In our experience, many people who are unhappy  in their marriage have extra-marital affairs.  Although a person getting divorced need not prove adultery in Florida to get divorced,  many people just want to know is my husband or  wife  cheating on me.  As divorce and family law attorney’s  located in Weston and  Coral  Springs,  Florida we help  our client’s identify the signs  that their spouse may be  having  an  affair.  Based upon our  37 years of legal experience, and our reading of the various literature, the following are just some signs that your spouse may  be having an extra-marital affair:

  1.   Your spouse changes banks or opens new bank accounts for no particular reason.
  2.   Your spouse has  secretive phone calls.
  3.   Unusual  periods of time in which your  spouse cannot be reached.
  4.   Your spouse changes their appearance.
  5.   Your spouse hides their cellphone for no particular  reason.
  6.   Your spouse picks fights for no reason at all.
  7.   They take  away your access to  their social media  accounts.
  8.   Your spouse starts to listen to strange or new types of  music.
  9.   Unexplained absences are quite common when someone participates in an extra-marital  affair.
  10.   You smell unfamiliar perfume or  cologne on  your spouse.
  11.   For no particular reason your spouse seems  to drop a strange name into your conversation.

Although you need not prove  adultery  in Florida,  the use  of  marital  assets is  considered  a “waste  of marital assets” in which the  non-offending spouse can seek compensation.  For example,  if  a Husband spends $20,000 on the extra-marital  affair, their  Wife will be entitled  to reimbursement from the cheating spouse in the amount of  $10,000.    Even though Florida is  a  no fault divorce state, this  is just  a very simple example how an extra-marital  affair can effect equitable distribution.
